FERPA and Public Record Request

 FERPA AND PUBLIC RECORDS

  • FERPA prohibits the release of some information (non-directory data).
  • FERPA permits the release of some information (directory data).
  • Wisconsin Open Records Law requires the release of information directory data because FERPA allows it.  Wisconsin Open Records Law cannot compel the release of non-directory data.

In general, the College must release student directory data under a public record request.  Student information with a FERPA hold will not be released under a public record request.
